Terms of Service

1. Agreement

These Terms are an agreement between you and SelfMD.ai ("selfMD", "we", "us"). By creating an account or using the service you agree to them and to our Privacy Policy. If you do not agree, do not use the service. You must be 18 or older.

2. What selfMD is, and is not

selfMD lets you:

• keep your own health records and documents in one place;
• ask an AI assistant for general, educational health information, including when it may be a good idea to see a clinician.

selfMD is not:

• a doctor, clinic, hospital, pharmacy, or telemedicine service, and using it does not create a doctor-patient relationship;
• a diagnostic tool: it does not tell you what condition you have, calculate your risk of disease, or predict your health;
• a way to get a prescription, medication dose, or treatment plan;
• a health insurer, and it does not bill insurance.

AI answers are generated by a general-purpose model and may be incomplete, out of date, or wrong. Always check with a qualified clinician or pharmacist before acting on health information, and never delay or skip care because of something selfMD said or did not say. If your message describes something that may be an emergency, selfMD may show a fixed safety message instead of an AI answer. That check is limited and will miss some emergencies, so do not rely on it.

3. Your account

• Give accurate information and keep your sign-in details secret. You are responsible for activity under your account; tell us promptly at privacy@selfmd.ai if you think someone else has used it.
• Only enter information about another person, such as a child or family member, if you have the authority to do so.
• Records you enter are only as accurate as what you put in. Keep them up to date.

4. Acceptable use

You agree not to:

• break the law or use selfMD to harm anyone;
• access anyone else's account or data, or try to get around our security;
• upload malware, or probe, scrape, or overload the service;
• pretend to be someone else or to be a licensed clinician;
• use selfMD's output to practise medicine or to make medical decisions for other people;
• try to get the AI to ignore its safety rules.

5. Your health information

How we collect, protect, share, and delete your information is described in the Privacy Policy. In short: selfMD is a consumer app, not covered by HIPAA, and we do not claim HIPAA compliance. You own the information you give us. You give us permission to store it, process it, and send your questions to our AI provider so that we can provide the service to you.

You can export or delete your data from Settings, subject to the notes in the Privacy Policy.

6. Paid plans

• Some features need a paid plan. Prices and limits are shown before you pay. Payments are processed by Stripe.
• Subscriptions renew until you cancel. You can cancel at any time in your account; cancellation takes effect at the end of the period you have paid for.
• Unless the law requires otherwise, payments already made are not refundable.

7. Our content and your content

The service, its software, and design belong to selfMD. We give you a personal, limited, non-transferable right to use it. You keep ownership of your content, and give us the limited right described in section 5. Educational text in the app is general information. It is not individually reviewed by a clinician.

8. Availability and changes

We try to keep selfMD running but do not promise it will always be available, accurate, or error free. We may change or stop features. If an AI answer cannot be generated, selfMD tells you so; it is not a sign that nothing is wrong.

9. Disclaimers and limits of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, INCLUDING THAT THE SERVICE OR ITS AI OUTPUT IS ACCURATE, COMPLETE, OR FIT FOR ANY MEDICAL PURPOSE. TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE. Nothing in these Terms limits liability that cannot be limited by law, or any right you have under consumer-protection or health-privacy law.

10. Ending your account

You can stop using selfMD and delete your account at any time (see the Privacy Policy for what is removed). We may suspend or end accounts that break these Terms or put the service or other people at risk. Sections that by their nature should continue (disclaimers, limits of liability, ownership) will continue.

11. Governing law and changes

These Terms are governed by U.S. federal law and the law of the state in which SelfMD.ai is established, without regard to conflict-of-law rules, except where your local consumer law gives you rights that cannot be waived. If we change these Terms in a way that matters, we will tell you in the app or by email before the change applies. Using selfMD after that means you accept the change. If any part of these Terms is unenforceable, the rest still applies. These Terms and the Privacy Policy are the whole agreement between us.
